House Election Integrity Committee Democrats Condemn Judge Clearing Path to USPS Enforcing Trump’s Mail-In Voting Interference

LANSING, Mich., Aug. 26, 2026 — Today, U.S. District Judge Indira Talwani temporarily removed a nationwide injunction that had prohibited the U.S. Postal Service (USPS) from enforcing Trump’s executive order to restrict mail-in voting for the midterm election. After Trump first signed the order in March, USPS released a final rule for federal ballot mail that included a plan to create a centralized list of voter information built from lists of absentee voters that states would have to turn over to the agency. Under the rule, the USPS would refuse to deliver ballots to any eligible voter who is not on that list. While the order is expected to face more legal hurdles, including from Michigan Attorney General Dana Nessel who signed on to a formal comment letter in July opposing the attempt to enforce federal control of elections, it remains unclear how Michigan’s mail-in voting will be affected.

In response to the removal of the injunction, Democratic members of the Michigan House Election Integrity committee — Minority Vice Chair Stephen Wooden (D-Grand Rapids) and state Reps. Mai Xiong (D-Warren) and Matt Koleszar (D-Plymouth) — issued the following statement:

“Michigan’s elections belong to the voters, and the voters have made it clear that they value secure, fair and accessible voting, whether that’s by mail or at the ballot box. Trump’s executive order and the USPS’s proposed rule are an unconstitutional power grab to meddle in our elections, because after years of making Michiganders poorer while he enriches himself and his buddies, it’s the only way his party can win.

“The president has never had constitutional authority over elections — and does not have it now. That authority belongs to the states. We commend Attorney General Nessel for her unwavering efforts to keep Michigan voter rolls safe and to protect every eligible voter’s right to vote by mail without federal overreach or interference. We fully support continued efforts to stop this unlawful abuse of power and to protect Michigan voters’ right to make their voice heard without imposition.”
