HAZEL PARK, Mich., Jan. 7, 2026 — Michigan State Attorney General Dana Nessel issued an opinion today concluding that House Republicans’ maneuver to claw back $645 million in previously-approved funding was unconstitutional. The opinion follows weeks of immediate and relentless actions from legislative Democrats fighting to restore the dollars promised to kids, moms, families, small businesses and more.

In response to Nessel’s opinion, state Rep. Mike McFall (D-Hazel Park) issued the following statement:

“I am happy to see the Attorney General confirm what many of us have been saying all along: the provision allowing one chamber to cancel these funds was unconstitutional. In our district alone, this includes $1 million already promised for Warren to make critical ADA-compliant park upgrades and a long-overdue new elevator at the Hazel Park District Library. Both projects are already underway, and without these funds, local communities would be stuck scrambling to cover these costs. That’s not right. When the state makes a commitment, our cities deserve certainty, not chaos. The fight is not over and I’m still fighting for you.”
