ANN ARBOR, Mich., Jan. 7, 2026 — Michigan State Attorney General Dana Nessel issued an opinion today concluding that House Republicans’ maneuver to claw back $645 million in previously-approved funding was unconstitutional. The opinion follows weeks of immediate and relentless actions from legislative Democrats fighting to restore the dollars promised to kids, moms, families, small businesses and more.

In response to Nessel’s opinion, state Rep. Jason Morgan (D-Ann Arbor) issued the following statement:

“This is a massive win for our communities and a direct rejection of the chaos we’ve seen in Lansing from House Republicans. Funding that was passed under a bipartisan budget was taken from kids, moms, schools, seniors, fire departments, veterans and small businesses across our state.

“We stood up, we fought back and we protected the resources our state promised to our neighbors. This opinion from the Attorney General sends a clear message: Michigan Democrats will not let anyone strip our communities of the tools they need to build a good life.

“The Attorney General’s opinion restores funding for local projects like the Ann Arbor election center and millions statewide for local water infrastructure, first responder equipment and the Rx Kids maternal health program. That said, House Republicans are doubling down on their corruption, so the fight keeps going and I won’t stop fighting for Michiganders.”
