In May 2025, the Trump administration issued an emergency order forcing the J.H. Campbell coal plant to stay open after its planned retirement.
Now, a federal appeals court has thrown out that order, ruling that the Department of Energy exceeded its statutory emergency authority and could not override Michigan’s long-term energy planning processes.
The ruling is a major win against federal overreach and for ratepayers, who have been forced to bear the cost of keeping an aging coal plant operating.

On the 25th anniversary of September 11, we honor the lives lost, the families forever impacted and the bravery of all first responders who ran toward danger. Today, we also thank our local firefighters, EMTs and police officers who continue that legacy of service and sacrifice.

Today, we celebrate that legacy and recommit ourselves to advancing policies that uplift working families and protect workers’ rights.

By training young people and helping them enter the maritime industry, this funding invests in the future of Michigan’s lakeshore and ensures it remains an economic driver for our state.

At a time when relief is needed, federal overreach is driving up costs. Consumers Energy now reports a $259 million net financial impact from complying with federal orders to keep the J.H. Campbell plant operating through June 30.
Campbell was supposed to retire in May 2025. Instead, Trump’s Department of Energy has now ordered it to remain open for the sixth time.
Michiganders deserve clean, reliable and affordable energy. They shouldn’t be forced to pay unnecessary costs to prop up a dirty, aging coal plant while its continued operation creates more waste and pollution.
