LANSING, Mich., June 12, 2024 — The Michigan House of Representatives passed House Bill 5569 today, sponsored by state Rep. Penelope Tsernoglou (D-East Lansing), with a vote of 108-2. The bill combats the nonconsensual creation or dissemination of AI-generated sexual images, imposing both civil liability and criminal penalties for offenders. The passage of this legislation comes at a time when the dangers of these highly realistic deep fake technologies have begun to enter the mainstream conversation.
“The passage of this bill was a crucial step in the effort to protect the people of Michigan from the abusive and exploitative act of creating or sharing nonconsensual intimate deep fakes.” Tsernoglou said. “The vast majority of the victims who are depicted in nonconsensual intimate deep fakes are women, who across the country, have experienced mental distress, financial harms, and even suicide as a direct result of these false depictions.
Under House Bill 5569, individuals who knowingly or recklessly create or disseminate nonconsensual intimate deep fakes will face severe consequences, including fines, imprisonment, and civil damages. Additionally, victims will be able to seek damages, temporary restraining orders, and injunctions to prevent further harm. Tsernoglou has been a staunch advocate for the regulation of artificial intelligence. In 2023, she sponsored House Bill 5141, which is now law and requires political advertisements generated by AI to include disclosures.
