LANSING, Mich., July 31, 2023 — In a 5-2 opinion, the Michigan Supreme Court ruled in the Andary v. USAA Casualty Insurance Co. case that the changes enacted in 2019 to Michigan’s no-fault auto insurance system do not apply retroactively. In response to this ruling, state Rep. Brenda Carter (D-Pontiac) issued the following statement:

“Today’s Michigan Supreme Court decision was undoubtedly the right one. As a result of the 2019 changes being misinterpreted, it has caused undue financial hardships and physical and mental duress. This ruling means a great deal — it goes a long way as families continue to heal and care for their loved ones after tragic accidents.

“Today’s ruling will inform the course of action moving forward. My colleagues and I on both sides of the aisle will continue to work together to find the strategic, nuanced solutions that will benefit policyholders in Michigan. We are going to keep the conversation going between lawmakers, stakeholders and the people of Michigan.”
