LANSING, Mich., Aug. 19, 2022 — Today Oakland County Circuit Court Judge Jacob Cunningham ruled in favor of Gov. Gretchen Whitmer’s request for preliminary injunction preventing county prosecutors from the enforcing the state’s 1931 abortion ban until the Supreme Court of Michigan rules on whether abortion is constitutionally protected in the state.

“Todays ruling keeps county prosecutors out of our private medical decisions and preserves the rights of pregnant women and doctors until the state Supreme Court has its say on the constitutional protection of abortion in Michigan,” said House Democratic Leader Donna Lasinski (D-Scio Township). “This is another victory for the constitutional rights of Michiganders — in a long battle Lansing Republicans are forcing us to fight. We could remove the threat of this abortion ban ourselves, right here in the Legislature, if not for the Republican majority fighting our every attempt to repeal this 90-year-old archaic law as we have called for again and again. Just this week Lansing Republicans voted again to keep this law on the books and failed to protect victims of incest and sexual assault.”
