LANSING, Mich., Feb. 4, 2025— State Rep. Denise Mentzer (D-Mt. Clemens) introduced House Bill 4040 to amend the Michigan Antitrust Reform Act. Under these changes, a business would be prohibited from entering into, obtaining or enforcing a noncompete agreement with a worker, or depicting that a noncompete agreement applies to a worker or former worker. This legislation is a reintroduction of House Bill 4399 from last term. Following the bill’s introduction, Mentzer issued the following statement:
“Requiring noncompete agreements for employees is truly an unfair labor practice that extremely limits an employee’s ability to pursue additional opportunities. Not only does this limit their ability to provide for their family but it also hurts Michigan’s economic competitiveness and stifles innovation. Ending this outdated practice is the right thing to do as we work to advance our economy, protect workers’ rights and help stimulate our economy here in Michigan.”
